Despite the OPLC unanimously selecting West Ham as the preferred tenant, Spurs decided to challenge the decision, based upon the fact that Newham Council will be providing a £40 million loan to the Hammers to fund the move.
Mr Justice Collins decided that Spurs have a case; following submissions and oral arguments from Tottenham’s attorney Dinah Rose claiming that the loan amounted to state aid.
A full hearing will now take place on the 18th October.
